He began his career as a criminal defense attorney and was drawn to the foreclosure defense field after observing that both areas of defense are fundamentally based upon the prosecutor’s or plaintiff’s ability to PROVE IT. That is, his criminal clients usually did something wrong, but it was the prosecutor’s legal obligation to prove beyond a reasonable doubt the crime as charged. In foreclosure defense almost all of his clients are behind in their payments, but the issue has become can the Plaintiff PROVE that it has the right to enforce the Note it is suing upon when the current Plaintiff didn’t originate the loan.
Foreclosure is no longer a simple process thanks to the Wall Street Intellectuals who set up a system requiring that the Promissory Notes be transferred into complex securities. Their complexity is beginning to haunt the large financial institutions who sought higher rates of returns by bundling loans in groups of thousands. It is this complexity, among other things, that Mr. Wrubel turns to the borrowers’ advantage by aggressively contesting creditors’ assertions that they have the right to enforce the Notes.
In September of 2010 Mr. Wrubel became one of the charter members of the Broward County Bar Real Estate Foreclosure Committee. He has lectured around the state of Florida about how the Uniform Commercial Code can be used to attack unauthorized signatures by robo-signers and others.
