Foreclosure Is an Opportunity
While your foreclosure is ongoing - and you are not making a mortgage payment - we'll keep you in your home for significantly less than your mortgage payment.
At the law firm of Michael Jay Wrubel, we understand that the threat of having your home foreclosed and taken away from you can be extremely frightening. As frightening as foreclosure may seem, it can also be an opportunity. Our goal is to help you make the most of this opportunity.
How is foreclosure an opportunity? It is an opportunity because it provides you with the right, through Florida's discovery process, to learn whether your creditor is even capable of proving that it lawfully acquired your Note and Mortgage. This process can take months, if not years, providing you with time to save money while you are not making loan payments. These savings can then be used by you in the future to help structure a loan modification or to help you move into your next property, if that is in your best interests. We are prepared to find these opportunities so that you can take advantage of them and stay in your home as long as possible, if not permanently.
Foreclosure Litigation Is Foreclosure Defense
We fight foreclosure by aggressively engaging in the discovery process, filing counterclaims and motions that advance your interests. This is true for both home and condo foreclosure defense. We engage in discovery to find the illegalities in promissory notes. These illegalities may include predatory lending issues, Truth in Lending Act (TILA) violations and more.
The most common flaw, however, is not in the loan itself, but in how the loan was assigned. Here is what we mean: You took out a loan from your neighborhood bank or credit union. However, it is not your neighborhood bank or credit union that is trying to foreclose on your property, is it? It is an entity that claims it acquired your loan. When that loan changed hands, important steps were often neglected and pieces of paper were lost along the way; steps and pieces that are needed to prove ownership of the Mortgage and Note. In order to foreclose, a bank or other financial institution needs to prove that they own the loan. We'll hold them to this task. As long as they cannot prove they own the loan, they cannot foreclose on your home while you and your family remain put.
Our goal is to stop foreclosure. Our intention is to give you time to learn what course of action is best for you. Beginning the litigation process can provide leverage so that loan modifications can be successfully negotiated in order to complete the process of owning your home. Foreclosure litigation is designed to help you stay in your home.
